RULES AND TERMS OF BOOKING A LODGING IN TOSTAY.NET

 

I. SUBJECT

TOSTAY.NET is a web based system, through which can be offered, sought and booked lodgings on a hotel principle.

On one hand, TOSTAY.NET offers to the owners of lodgings or to authorized by them persons the opportunity to register and publish their own lodgings in the system and can manage their occupation and finance on their own as a result of their booking in TOSTAY.NET

On the other hand , TOSTAY.NET offers to their customers the opportunity to search, compare, choose and book the most appropriate for them lodgings by prior entered by them criteria.

II. BOOKING  

1. Booking of a chosen lodging can be made, not later than 24 consecutive hours prior accommodation. If a booking of a shorter period is needed you must   address the authorized by TOSTAY.NET administrator for the relevant destination.

2. In TOSTAY.NET there can be booked  two types of lodgings. The first type of lodging is managed by its owner or a an authorized by the latter person, an the other one by TOSTAY.NET.

3. Upon sending the booking /booking form/ to TOSTAY.NET by pressing the Button "Send a booking" a request of booking is made that in certain cases must be confirmed by the owner of the chosen lodging or by an authorized by the latter person. Following its confirmation, the customer receives and email through which the booking fee can be paid.

4. For TOSTAY.NET a booking is successfully made when the booking fee is received tot he amount appointed in the booking form filled in by the customer.

5. Within 48 hours as per the date on which the confirmed request is confirmed, the customer must pay the booking fee to the amount appointed in the filled in booking form. Payment of booking fee is carried out through a credit or debit card by an authorised mediator – www.moneybookers.com or by bank to the following bank account:

6. In all cases where TOSTAY.NET successfully sends an email to the appointed by the customer email address it is always deemed as notified.

7. The customer   is liable   of to what extend the information has been filled in correctly and properly in the submitted booking form by TOSTAY.NET.

III. PRICE OF THE BOOKING

8. The appointed total amount of stay in the filled in by the customer booking form includes booking fee which is paid upon making a request of booking and additional payment fee that is paid upon accommodation.

IV. ACCOMMODATION  

9. The accommodation in a booked by the customer lodging is carried out only after prior agreement with an authorized by TOSTAY.NET   administrator for the relevant destination that is due to be made not later than 24 consecutive hours before the date on which the customer must be accommodated.

10. The customer can find information for the contacts of the authorized by TOSTAY.NET destination administrator by pressing Button "Contacts".

11. The authorized by TOSTAY.NET representative meets the customer infront of the building where the very lodging is set.

12. In case that the customer is late with more than one hour as per the prior agreed time of accommodation, the same undertakes to make call and inform of this TOSTAY.NET in the due time.

13. In case that the customer is late with more than one hour as per the prior agreed time of accommodation and has not made a call to warn of this in the due time, the same owes to the sent by TOSTAY.NET representative 20 Euro as a result of this delay.

14. In case that the customer does not appear until 08:00 a.m. on the day following his/her accommodation and has not warned of this in the due time TOSTAY.NET   cancels the made by the customer booking and deducts the full amount of the paid by the latter booking fee unless he/she has paid the total price of the booking made by him/her .

15. On the day of the accommodation, the customer is given a rental contract and a statement of acceptance with an inventory of the condition of the Short stay properties and the equipment in the booked lodging to sign and after that the sane is accommodated.

16.On the day of the accommodation, the customer must pay to the authorized by TOSTAY.NET representative the remaining of the made booking fee and the guarantee deposit that serves for covering the dames caused during his/her and the rest of the guests stay.

17. The deposit is refunded in total in case no damages are found upon releasing the booked lodging.

18. In case damages are found, the same are fixed on the account of the customer from the guarantee deposit.

19. In case the amount of the caused damages exceed the amount of the paid by the customer guarantee deposit, the same undertakes to refund them to the total amount.

20. The amount of the due by the customer guarantee deposit is to the amount of the price of one night stay of the booked by him/her lodging for each guest but not more than 200 euro.

V. PROLONGING THE STAY  

21. In case that the customer intends to prolong his/her stay at the booked lodging, the same must notify of this TOSTAY.NET but not later than 24 consecutive hours prior the end of the rental period.

22. TОSTAY.NET reserves the right to refuse the customer prolongation of his/her stay if there is a confirmed booking of the same lodging. In this case the customer is offered to be accommodated at another lodging.

VI. RELEASE /strong>

23. The customer undertakes to release the booked lodging not later than 12:00 o'clock on the day following the day of his/her last night of stay.

24. In case that the customer does not release the booked lodging until 12 o'clock on the day following his/her last night of stay, the same is deducted an amount of 20 Eeuro for every hour of delay from the paid guarantee deposit upon accommodation.

25. Upon releasing the booked lodging, the customer is given a statement of acceptance with an inventory of the condition of the Short stay properties and the equipment in the booked lodging.

26. TOSTAY.NET is sending to customer on the day following g the day of his las night stay an email with a link which pressed activates guests book that afford the customer to make an opinion and assessment of the booked lodging.

VII. CANCELLATION AND TERMINATION OF THE BOOKING, REFUNDING AMOUNTS  

27. In order to cancel a confirmed by TOSTAY.NET booking, the customer must send an email to the authorized by TOSTAY.NET administrator for the relevant destination with which to ask for cancellation of the booking made.

28. The cancellation is in force only if confirmed by the authorized by TOSTAY.NET destination administrator by sending an email to the appointed by the customer email address.   The customer can information of the contacts for the authorized by TOSTAY.NET destination administrator by pressing Button "Contacts".

29. Cancellation of booking made not later than 15 days prior the date of accommodation leads to deduction of 50 % of the paid the customer booking fee. The remaining amount of the paid booking fee is refunded to the customer within 30 days time as per the confirmation of the cancellation by TOSTAY.NET .

30. The cancellation of booking made later than 15 days prior the date of accommodation leads to deduction of the total amount of the paid by the customer booking fee.

31. TOSTAY.NET is entitled to cancel the booking only in extraordinary cases. In these cases the customer is offered to be accommodated in another lodging with similar characteristics and is he/she renounces it all paid by the latter amounts up to this moment are refunded by TOSTAY.NET within 30 days times as per the confirmation of the cancellation .

32. In case that the customer want to terminate his/her stay prematurely at the booked lodging, TOSTAY.NET deducts the total price of the entire booking.

VIII. OBLIGATIONS  

33. The published in TOSTAY.NET lodgings are designated for tourist, vacation or business visitations and cannot be used for other purpose.

34. The published in TOSTAY.NET lodgings cannot be rerented or reconstructed.

35. In the published in TOSTAY.NET lodgings no animals are allowed for accommodation unless   with advance permission of the appointed contact person.

36. The customer and the remaining guests undertake not to make noise and break the quietness of the rest of the residents in the building.

37. Brining in, storing or using flammable substances, explosives or radioactive materials in the published in TOSTAY.NET lodgings and in the buildings where the same are set is prohibited.

38. The customer undertakes to take the care of the good husband regarding the booked lodging, the Short stay properties and the equipment in it.

39. For every damaged occurred in the booked lodging, the Customer undertakes to inform TOSTAY.NET immediately.

40. The customer undertakes to return the possession of the booked by him/her lodging, Short stay properties and equipment in it in the condition it has been rented. The loss or the replacement of keys, electronic cards or remote controls are on the account of the customer.

41. For each ungrounded call of a representative of TOSTAY.NET on behalf of the customer, the same will be deducted an amount of 20 Euro from the paid by the latter guarantee deposit.

42. If it has been found that at the lodging more than the requested with booking form number of guests accommodated themselves, TOSTAY.NET is entitled to terminate the entered with the customer rental contract prematurely and immediately remove the customer from the booked lodging by retaining all paid by the latter amounts.

43. The customer undertakes to observe the rules of internal order established in the building where the booked lodging is set.

44. In case of inobservance of the rules established by TOSTAY.NET or the rules of internal order established by the relevant building, TOSTAY.NET is entitled to terminate the entered with the customer rental contract prematurely and immediately remove the customer from the booked lodging by retaining all paid by the latter amounts.

IX. LIMITATION OF THE LIABILITY  

45. TOSTAY.NET is neither liable for caused damages or missed profits nor for possible damages, theft, failure occurred for the customer or for his/her Short stay properties and accessories during the time of his/her stay. The customer is solely liable for protecting his/her chattels.

46. TOSTAY.NET is not liable for the consequences from circumstances or events that are beyond their control – occasional events, insurmountable force, action or inaction of third persons including of the owners of the lodgings or the authorized by them persons and others.

X. ADDITIONAL SERVICES

47. TOSTAY.NET also offers to its customers the following services from which they can benefit against certain remuneration:

  - transfer, cleaning, laundry, ironing, home delivery, rent a car.

48. The customers can benefit from the offered by TOSTAY.NET additional services only after prior agreement that is due to be made not later than 24 consecutive hours prior the date on which they must be accommodated.

XI. KNOWLEDGE AND CONSENT

49. By making a request of booking of the chosen by the customer lodging it is deemed that the same ahs read, accepted and agreed with all rules and terms, mentioned above. The customer undertakes to follow and observe them.

XII. APPLICABLE LAW

50. Regarding unsettled with the present rules and terms issues the provisions of the effective legislation of the Republic of Bulgaria apply.

XIII. FINAL PROVISIONS
